The illegal use of bottle design of LLC «Hydrolife Bottlers» In Samarkand 01.07.2012 18:37
In late May 2012 as a result of activities undertaken by the Centre against counterfeiting, it was found that LLC «TESCO PLUS conducted illegal bottling with the release and implementation of the water under the brand name «SAMARKAND PURE WOTER - BOGIBALAND» similar to the degree of confusion with industrial design - five-liter plastic bottle, the license belonging to LLC «Hydrolife Bottlers». LLC «Hydrolife Bottlers» is one of the leading manufacturers of drinking water in Uzbekistan. The core business is the production and sale of bottled drinking water. Examination, with the participation of a lawyer authorized patent attorney and an expert in the field of unfair competition, was established similarity of confusion above five-liter plastic bottles. Examination and has been implemented according to the requirements of the "Rules of filing and consideration of the application for registration of a trademark and service mark" registered by the Ministry of Justice on 29.07.2009, № 1988. During the further elaboration, evidence of illegal activity by LLC «TESCO PLUS» bottling in five-liter PET bottle counterfeit branded water «SAMARKAND PURE WOTER - BOGIBALAND» has been collected. Test purchases, photo documentation and collection of necessary documentation has been conducted. After that, the management LLC «TESCO PLUS», has receivrd a notification that the industrial design-five-liter plastic bottle, is licensied by OOO «Hydrolife Bottlers». After presenting the notification and relevant documentary materials management LLC «TESCO PLUS» decided to immediately cease activity in the part concerning the violation of intellectual property rights LLC «Hydrolife Bottlers».
