Methods of workThe organization of anti-counterfeit activities In foreign countries, there are dozens of anti-counterfeit agencies that specialize in the field of legal aid. Anti-counterfeiting is a serious activity as for companies that produce products and for professionals involved in the fight against counterfeiting. In Uzbekistan, this direction is yet to be developed. Despite this, the experience allows us to offer solutions, whose implementation is quite able to even small and medium businesses. These activities include: a) Monitoring violations of intellectual property rights throughout the territory of Uzbekistan; b) recording violations of intellectual property rights, including the wholesale and retail, supermarkets and large chain stores, electronic media communication and information in the import and export through the customs border, etc.; c) The implementation of preventive measures on the basis of the definitions of courts; d) Control of procurement organization with anti-monopoly, tax, customs and other authorities; e) Excitation of administrative and criminal cases, their maintenance according to Code of Administrative Responsibility of the Criminal Code of Uzbekistan, including the confiscation of counterfeit goods, as well as a ban of production, sales and advertising; f) Maintenance of economic and civil cases involving violations of intellectual property rights; g) Expert advisory support of cases of unfair competition in antimonopoly authorities; h) The inclusion of intellectual property rights to the database credentials of the customs authorities. Prior to the listed events, usually patent-legal audit is held, the aim of which is to determine the readiness of the intellectual property object to protection measures. In some cases it may need to change the methods and scope of legal protection, and sometimes registration of additional intellectual property. |
